Alcohol breath below the limit: graded sanctions
The Reglamento grades the consequences when there is alcohol breath but the prohibited levels are not exceeded. In the upper band (a blood-alcohol level between 0.060 and 0.079 — still below the limit — with a breath level under 0.40 mg/L), three measures apply: a fine classified as serious (grave), precautionary immobilization of the vehicle for posing a risk to traffic — unless another person, called on by the driver, can take over the driving — and a warning.
