Civil liability and mandatory insurance

Whoever is responsible for a traffic accident must repair the damages and harm (daños y perjuicios) caused to the physical integrity, health, and property of the people affected.

Before using the public ways of the State, every owner, possessor, or incidental driver of a combustion, hybrid, mixed, or electric vehicle must make sure the vehicle has the hologram and a valid third-party damage insurance policy. Article 104 adds the on-board rules: the hologram goes on the left end of the rear window (below the emissions-verification hologram), the policy must be carried in the vehicle in good condition, and the driver must hand it to the agents after committing an infraction or being involved in an accident.
